2. TERMS OF BUSINESS
The following part of BuyNewCarsOnline.co.uk sets
out the contract terms which apply as between the customer,
BuyNewCarsOnline and UK supplier of new and used vehicles.
The details of vehicles on the website (particularly as
to price, lead time and options) are based on information
provided to BuyNewCarsOnline by its UK suppliers (Dealers and Sellers)
who have indicated their willingness to supply vehicles
to customers via the website.
Access to BuyNewCarsOnline.co.uk is to allow configuration
of the vehicle required by the customer, including make,
model, specification and colour, options and associated
costs, together producing an 'on the road' price.
This information is confirmed in a pre-order
page.
Finance and loan can be arranged by the
dealers and are subject to status. Written details available
from the dealer or lender upon request.
3. THE SUPPLIER ORDER AND PAYMENTS
Once a dealer confirms the price, availability
and delivery date to the satisfaction of the customer and
the customer wishes to proceed, the supplier will provide
a customer order form.
Any deposit is paid direct to the UK vehicle
supplier.
Any balance of the purchase price is paid
in similar manner prior to or at the same time as the vehicle's
collection or delivery.
The function of BuyNewCarsOnline in the transaction
is to provide the website on which the vehicle is pre-ordered
and to facilitate the customer's purchase of the vehicle
through providing online information.
- BuyNewCarsOnline does not sell the vehicle to the customer and
does not buy the vehicle from the supplier
- BuyNewCarsOnline does not provide technical information or any
warranties for vehicles sold using the website
- BuyNewCarsOnline accepts no responsibility for the vehicle transaction
made between the customer and the dealer
4. PRICE CHANGES
If a price change affecting the vehicle
(other than related to changes in specification) is imposed
on the supplier by the manufacturer effective after the
contract date the customer agrees that the supplier may
supply the vehicle and that the price change may be passed
on to the customer - unless a written agreement exists
to fix the price by the dealer.
5. VEHICLE DEFECTS AND NON-CONFORMING
SPECIFICATIONS
Any defects in the vehicle, provided that
the defect is serious enough to justify rejection, must
be notified to the supplier in writing as soon as possible,
and not more than 2 days after delivery. Please read supplier
terms and conditions for more details.
6. GENERAL NOTICES
Any notice given by any party must be
in writing. Save for notices sent by the customer pursuant
to clause 2 above, any party will be treated as having
received any letter addressed to it at its correct address
given on the customer order on the first working day after
posting (if sent by Royal Mail Special Delivery) or on
the second working day after posting if sent by first class
pre-paid mail Since any notice may be time critical it
is agreed that no notices will be sent by second class
pre-paid mail. A letter posted on a Sunday, bank or public
holiday is treated as having been posted on the next working
day. In the case of e-mail or fax, delivery shall be deemed
to take place on the next working day.
7. CUSTOMER RIGHTS
The customer's rights of cancellation
stated above are without prejudice to the customer's statutory
rights, including rights under the relevant consumer legislation.
In particular, nothing in this agreement shall be deemed
to exclude the application of the Consumer Protection (Distance
Selling) Regulations 2000 or otherwise derogate from any
rights granted thereby.
8. ENFORCEABILITY
If any of these terms is held by any competent
authority to be invalid or unenforceable in whole or in
part, the validity of the remainder of the provision and
all other provisions shall to the maximum extent permissible
remain unaffected.
9. ENGLISH LAW
The Contract is governed by English law
and any dispute arising under or in connection with it
shall be subject to the jurisdiction of the English Courts.
